Licence & purchase terms
iFlyDesign — licence and purchase terms
Version: 2026-10-10-1
1. Seller and contact
The seller is IFLY DESIGN LTD, trading as iFlyDesign, 1–3 Gloucester Road, Bishopston, Bristol, BS7 8AA, United Kingdom. Questions, cancellation requests and complaints: hello@iflydesign.com.
2. What you buy
You buy a non-exclusive licence to use the selected photograph or footage, together with the downloadable file described on its product page. Copyright and ownership remain with the rights holder. No physical prints, exclusivity, source project files or transfer of copyright are included. Check the advertised file format, dimensions, duration and licence before ordering. TIFF, JPEG and MP4 files require compatible viewing/editing software and sufficient storage.
3. Personal licence
For one individual, worldwide, without a fixed expiry, for non-commercial use: personal screens and devices, private creative projects, personal prints and non-commercial personal social posts. You may crop, resize and edit the file for these uses. Business advertising, client work, monetised content and resale require a commercial licence or separate written permission.
4. Commercial licence
For one purchasing business or one named end client, worldwide, without a fixed expiry: websites, social media, digital advertising, presentations, editorial publications, printed marketing materials and finished film/video productions. Cropping, resizing and editing are permitted. Contractors may handle the file only to carry out the licensee’s project, must keep it secure and acquire no independent rights. Agencies purchasing for multiple clients need a separate licence for each client. Physical or digital products whose primary value is the photograph or footage, including art prints for sale, templates and merchandise, require a separate written agreement.
5. Restrictions applying to both licences
Do not resell, sublicense, share or redistribute the original or a substantially equivalent file; list it on stock libraries; offer it for download; use it as a trademark/logo; or use it to train an AI model or dataset. Do not claim authorship or use it unlawfully or in a misleading endorsement. A credit to iFlyDesign is appreciated but is not required. An embedded image or clip within an allowed finished project may be published; the source file may not be distributed as a standalone asset.
6. Third-party rights
Unless expressly stated otherwise for a specific item, no model, property or trademark release is supplied. The licence covers the rights iFlyDesign holds in the photograph/footage. It does not grant third-party permissions or warrant that every proposed use is cleared. Check the permissions needed for your use, particularly advertising implying endorsement by identifiable people, brands or property owners.
7. Prices, checkout and orders
Prices are in GBP. The seller is not VAT registered and no VAT is charged. The full basket total is shown before payment. Payment is processed by Stripe. A licence and download entitlement begin only after payment is confirmed. Failed, cancelled or pending payments do not grant rights. If an item cannot be supplied, we will arrange a replacement agreed with you or refund the affected payment. Keep the private order link and licence confirmation. Treat the link as confidential because anyone holding it can access the purchased files. If access is lost, contact us with your order number or receipt; we will verify ownership before restoring access.
8. Immediate digital supply and cancellation
Before paying, you must actively agree to these terms and expressly consent to supply of the digital downloads beginning immediately after confirmed payment. You acknowledge that your statutory 14-day cancellation right ends when digital supply begins with that consent and acknowledgement. We record these choices and make the purchase/licence confirmation available for you to save. If you have not consented to immediate supply, do not proceed with this instant-download checkout; contact us to discuss an alternative.
9. Refunds and faults
Contact hello@iflydesign.com with your order number and a description of the issue. A change of mind after digital supply has begun with the required consent does not normally qualify for a refund. This does not remove statutory rights for faulty, misdescribed or otherwise non-conforming content. Where applicable, we will provide repair or replacement within a reasonable time and without significant inconvenience, or an appropriate price reduction/refund if that remedy is unavailable or unsuccessful. Duplicate charges will be investigated and any confirmed duplicate payment refunded. An approved refund ends the licence for the refunded item except where your statutory rights provide otherwise; stop using that item and delete copies. Download access may be suspended while a payment dispute is resolved.
10. Your rights and complaints
Nothing in these terms excludes or limits rights or liabilities that cannot lawfully be excluded or limited, including consumers’ statutory rights. Contact us first so we can try to resolve a complaint. These terms are governed by the law of England and Wales without depriving consumers of mandatory protections or court rights in their place of residence.
